FAQ

Questions about
family law.

Concrete, free of legal jargon. If your question isn't here — write to me.

How much does a divorce case in Poznań cost?

The court fee for a divorce petition is PLN 600. The attorney's fee starts from several thousand zlotys and depends on the complexity of the case.

Can I avoid a court hearing during a divorce?

A hearing in a divorce case is generally required, because the court must establish whether there has been a permanent and complete breakdown of the marriage. The parties can, however, speed up the proceedings by filing agreed motions and presenting a complete position at the outset.

How long does a maintenance case take?

The first decision securing maintenance for the duration of the case is usually issued within 4–8 weeks of filing the application. The whole proceeding generally ends in 6–18 months.

Which parent has a better chance in a custody case?

Polish family law does not favour the parent's gender. The court analyses the welfare of the child — emotional bonds, living conditions, time availability, parenting competence. Shared custody is increasingly ordered.

What is the difference between divorce and separation?

Separation does not dissolve the marriage — it can be lifted at any time. It makes a return to married life easier but does not allow a new marriage. The financial effects are similar in both cases.
