Is it worth filing a payment claim for an amount below PLN 5,000?

Yes, if you have strong documentation — in simplified proceedings the costs are low and the order for payment is issued quickly. I will strategically assess whether it is worth it before you incur court fees.

How long does a payment claim take?

An order for payment in writ proceedings is usually issued within 1–3 months. If the debtor files an objection, the case proceeds in the ordinary mode for 8–18 months.

What is an actio pauliana?

It is a mechanism that protects a creditor against acts by which a debtor deliberately strips assets (e.g. by gifting real estate). The court may declare such an act ineffective against the creditor. The deadline is 5 years from the act.

Can I pursue compensation from an insurer on my own?

You can, but practice shows that without legal support the amounts paid directly by insurers are often significantly understated. After analysing the case I indicate the realistic ceiling of the claim and the route to pursue the difference.

What are Swiss franc (CHF) mortgage loans and can they be challenged?

Loan agreements denominated in or indexed to CHF often contain abusive clauses. Courts commonly declare them invalid or strike out the clauses. I help assess the agreement and conduct the case from the demand for payment to a final judgment.
